font-family: arial, helvetica, sans-serif; color: rgb(192, 0, 0);">二、农民工工资保证金管理主体</span></strong></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">农民工工资保证金按照行政区划范围实行属地管理，原则上由工程项目所在地县级以上人力资源社会保障部门负责管理。</span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="color: rgb(192, 0, 0);"><strong><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">三、实行农民工工资保证金差异化缴存</span></strong></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">在同一行政区域内，可根据行业特点和企业信用状况等适当调整农民工工资保证金缴存比例。</span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">（一）在我县范围内工程建设领域施工企业（以下简称“施工企业”）农民工工资保证金按单项工程合同造价的一定比例缴存。5000万元（含5000万元）以下的，按合同价1%的比例缴存，缴存金额低于5万元的，按5万元缴存；合同项目在5000万元以上的，按合同价0.8%的比例进行缴存，缴存金额低于50万元的，按50万元缴存。</span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">（二）重点公路水运工程、重大水利工程及铁路工程等项目单个工程合同造价超过5个亿的，或同一施工企业有多个在建工程项目的，且施工企业信用状况良好的，农民工工资保证金按照400万的标准上限交纳（分标段交纳的除外）。</span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">（三）施工企业在我县范围内已承建的工程项目落实农民工工资保证金、农民工工资专户、实名制管理、考勤管理、银行代发工资、劳动合同管理、维权告示牌等制度到位，在一定时期内未发生拖欠农民工工资行为的，经施工企业申请，新开工项目农民工工资保证金可适当降低缴存比例或免于缴存（起算时间从缴款之日往前追溯）：</span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">1、在我县一年内未发生拖欠农民工工资且获得劳动保障诚信B级以上施工企业，按工程合同造价的0.5%缴存农民工工资保证金；</span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">2、在我县连续两年内未发生拖欠农民工工资且获得劳动保障诚信B级以上施工企业，按工程合同造价的0.4%缴存农民工工资保证金；</span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">3、在我县连续三年未发生拖欠农民工工资且获得劳动保障诚信A级以上施工企业，经农民工工资保证金管理部门同意后，可以免于缴存农民工工资保证金，由企业自行建立农民工工资保证金。</span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">（四）已享受农民工工资保证金减免缴纳的施工企业，发生拖欠农民工工资受到通报处理的或纳入重大劳动保障违法行为社会公布的或列入拖欠农民工工资“黑名单”的或在建项目“农民工工资专户”管理混乱的，施工企业新开工项目一律按工程合同造价的2%缴存农民工工资保证金。</span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="color: rgb(192, 0, 0);"><strong><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">四、推行银行保函等第三方担保制度</span></strong></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;"><br/></span></p><p style="font-size: medium; white-space: normal; line-height: 33px; text-indent: 0em;"><span style="font-size: 16px; font-family: arial, helvetica, sans-serif;">允许信用较好的施工企业（达到劳动保障诚信A级企业标准的）以银行保函方式缴存农民工工资保证金。银行保函的种类应当是见索即付的独立保函，由施工企业向工程项目所在地的商业银行申请开立，受益人为工程项目所在地农民工工资保证金管理部门。</span></p><p style="font-size: medium;
